Terms and Conditions Agreement – Basmetech Platform

Preamble and Legal Consent

This document constitutes a legally binding agreement ("Agreement") between Basmetech Platform ("Platform," "we," "us," or "our") and you as a user ("User," "you"). Your access to the Platform, account creation, or completion of any purchase constitutes an explicit, irrevocable legal acknowledgment of your full acceptance of all terms stated below. If you do not agree to any of these terms, you must immediately cease using the Platform.

Legal Capacity

To use the Platform's services and enter into financial obligations, you acknowledge and warrant that you are at least eighteen (18) years of age and possess full legal capacity. If the Platform is used by a minor, it must be under the supervision and explicit consent of a legal guardian, who thereby assumes full legal and financial responsibility for all activities conducted through the account.

Intellectual Property Rights (Content Protection)

All digital materials available on the Basmetech Platform, including but not limited to courses, videos, text files, work templates, graphic designs, trademarks, and logos, are the exclusive and registered intellectual property of the Basmetech project and are protected under international copyright and intellectual property laws.

• Granted License: Upon completing a purchase, the User is granted a limited, non-exclusive, non-transferable, and non-sublicensable license for individual personal use only.

• Strict Prohibitions: It is strictly prohibited to copy, modify, resell, distribute, record (screen/audio), or use any part of the content for commercial or training purposes, or to share it across other platforms without prior documented written permission. Any violation of this clause will result in the immediate termination of the account without refund, while the Platform retains its full right to pursue legal action and claim financial compensation for damages.

Account Security Policy (Anti-Abuse)

The Platform is committed to providing a secure environment for users and enforces strict policies to prevent manipulation and abuse:

• Individual Use: The account is intended for a single user only. Sharing login credentials (username and password) with any third party under any circumstances is strictly prohibited.

• Technical Security Monitoring: The Platform utilizes advanced tracking systems (IP Tracking) to detect unusual login patterns. Detecting simultaneous logins from disparate geographic locations or multiple devices constitutes a security breach and grants the Platform the right to immediately suspend or permanently close the violating account.

• General Conduct: The User agrees not to use the Platform for any illegal purposes, attempt to breach its servers, or use offensive or defamatory language within any of the Platform's discussion spaces.

Financial Matters and Payment Gateway Compliance

These clauses are formulated to ensure full compliance with the policies of global payment gateways:

• Pricing and Taxes: All displayed prices are subject to change without prior notice. The User is responsible for any bank transfer fees, taxes, or customs duties imposed by the competent authorities in their country of residence.

• Payments and Disputes (Chargebacks): By completing the payment process, you authorize the Platform and its payment gateway partners to deduct the specified amount. In the event of a financial dispute, the User must first contact the Platform's technical support to reach a resolution. Resorting to a "Chargeback" request through the bank or credit card provider arbitrarily or without valid justification constitutes a material breach of the Agreement. This will result in permanent account suspension, reporting the incident to payment gateways, and taking legal action to recover the owed amounts and dispute fees.

Refund and Privacy Policies

Both the "Refund Policy" and "Privacy Policy" form an integral part of these binding Terms and Conditions:

• Refund Policy: Due to the immediate nature of digital products, all cancellations and financial refunds are subject to the detailed conditions outlined on the return and cancellation policies page.

Disclaimer of Warranties (Earnings Disclaimer)

• Results Not Guaranteed: The Basmetech Platform provides educational and strategic content aimed at skill development. The Platform makes no promises or guarantees, express or implied, regarding the achievement of specific income levels or financial success. Results depend entirely on the User's level of commitment, personal effort, and fluctuating market conditions.

• Service Availability: Services are provided on an "as is" and "as available" basis. Although we strive to ensure the Platform operates with high efficiency, we do not guarantee it will be completely free from interruptions or technical errors beyond our control.

Limitation of Liability and Indemnification

To the fullest extent permitted by law, the Basmetech Platform, its directors, or employees shall not be liable for any direct, indirect, incidental, or consequential damages (including loss of profits or data) arising from the use or inability to use the Platform. The User agrees to indemnify and hold the Platform harmless from any claims, losses, or costs (including legal fees) arising from their breach of this Agreement or their violation of any third-party rights.

9. Amendments and Governing Law

• Updates: The Platform reserves the absolute right to modify or update these terms at any time. Your continued use of the Platform after the publication of modifications constitutes your explicit consent to the updated terms.

• Governing Law: This Agreement shall be governed by and construed in accordance with the laws and legislations regulating electronic commerce applicable internationally or locally, as required by the nature of the dispute.
